    Filing HOH - Considered unmarried

    I have a situation where the divorce has not been final, the couple has lived apart for over six months, and have a ($14000) capital loss. Since they are each filing HOH it would seem that they can each deduct a ($3000) loss. Am I correct?

    Follow the money!!!

    You need to determine if both spouses contributed to the investment account where the loss was generated.
