I have a client that is noncitizen US resident who has w2 income and a rental property in India. My question is can he take the rental loss on a foreign property?

If this taxpayer is filing a 1040 then file Sch E. Make sure depreciation is using commercial property schedule and not US residential depreciation 27.5 yrs. Also if a tax on the rental income is paid in foreign country a FTC may be applicable. Finally consult the tax treaty between India and USA to see if there are any special rules that may apply. The main issue is converting foreign currency exchange rate. I have used the rate prevailing at the end of the tax year.Taxes after all are the dues that we pay for the privileges of membership in an organized society. - FDR
