    2017 Payroll Issue

    Taxpayer is employed by large company. Due to miscalculations of fringe benefits, taxpayer had incorrect taxable income included in 2017 W-2. Taxpayer requested that employer correct W-2 and was advised that taxpayer would need to file an extension so that employer had time to correct. Now employer is stating that employer is unable to correct due to outdated payroll software and would like to balance out error in 2018. What would other tax preparers recommend to taxpayer in this situation?

    For a large company, it's highly unlikely that this employee is the ONLY employee effected by the error.
    When did the employee notify the employer of the error?
    Outdated payroll software is no excuse - the employer just doesn't wish to do the extra work to correct the error.
    If the employer refuses to cooperate, then I would (or really the employee should) inform IRS about this.

      Taxpayer realized error when reviewing his W-2 and notified employer in January of 2018.

        Use Form 4852

        How about using Form 4852? The taxpayer may be hesitant to report to IRS fearing retaliation from the employer.
