I have some 1065 returns that I sent last night (right at the due date) but state was held until Federal was accepted. The state will transmit tonight. Will I get penalized by state for being late or will they be able to see that the efile was transmitted by the due date?

Or, ask your state! How would anyone here know what your state agency will do, when we don't even know what state? On a side note, I had several 1065/1120S returns & extensions that were fully accepted & ack'd by my state before the federal file was even transmitted to IRS."You said it, they'll never know the difference.
