    Partnership switched to an S- Corp - lawyer told them they could keep the EIN they had for the partnership - I disagree but wanted to throw it out here to see if I am correct.

    It depends. It is just a Partnership? Or was it an LLC/Partnership that made the election to be taxed as a corporation?



    Partnerships ... You will be required to obtain a new EIN if any of the following statements are true ... You incorporate.


    Limited Liability Company (LLC) ... You will not be required to obtain a new EIN if any of the following statements are true ... An LLC that already has an EIN chooses to be taxed as a corporation or as an S corporation.

    Generally, businesses need a new Employer Identification Number (EIN) when their ownership or structure has changed. Determine if you need a new EIN.

      Not an LLC

      It is not an LLC therefore it will need the new EIN
