Allowed Open Market Health Insurance Credit when covered by medicare all year?

I have an Arkansas resident tp who purchased health insurance on the open market for 2015 & got tax credit to pay part of the health insurance premiums.

The TP's disabled spouse also was under medicare all of 2015.

    (1) Are your not allowed the open market tax credit if you are covered another health insurance somewhere, including medicare?

    (2) If not, what do we do now?

    I appreciate your help. mikeburg

Are you saying the Marketplace policy covered both spouses, but one spouse also had Medicare?

If so, the proper SLCSP (column B of the 1095-A) would be the amount that covers the family EXCEPT the Medicare spouse. If it is just the two spouses, then you would only look up the cost for the non-Medicare spouse.

You can look that number up here and enter it on your 8962: https://www.healthcare.gov/tax-tool/

Let the taxpayers know that they could receive an IRS notice asking if they entered the SLCSP correctly.
