Taxpayer claiming HOH , but not claiming the dependent on the tax return. Other parent claiming child. The child has no heath insurance. Who's return
should calculate the penalty?

1. TTB HEALTH CARE AND RETIREMENT, PP. 3-8 THROUGH 3-11, STATES TAXPAYER CLAIMING A DEPENDENT IS REQUIRED TO PROVIDE HEALTH INSURANCE OR CLAIM AN EXEMPTION.
2. Bottom of Pp. 3-8 right column deals with dependents who do not live with a taxpayer.
3. IF the child was covered by the custodian parent' s health insurance, we have treated the child as covered even if the non-custodial parent does not have health insurance.
4. There is also that policy allocation stuff for divorced and separated parents (TTB HCAR P. 3-16, right column, top of page).
Friends double; family triple. Don't buy an audit for yourself. If someone has to go to jail make sure it is the client. Remember it is only taxes, nothing important.
