    2012 return not yet filed

Client failed to file 2012 return. I prepared and he said he mailed. Called IRS, they had no record of the return, and neither did the state. Not sure how both could have gotten lost in the mail, but that's not important. Now, we are another year. IRS has not contacted him. In 2012 he drew out retirement too early, has a penalty, and owes some tax. He wants to know if he should wait til they contact him, or file the 2012 again? He owes money he does not have. He owns nothing and just works odd jobs to get by. What should my advice be?

ive looked at installment options, what about oic. When I put in his numbers as to what he has, owns and makes, oic looks like his best option. looks too easy, is it really?

      File the return

Need to have the 2012 tax return filed and any other missing years filed first. Reprint the Federal and State, have the client sign them, put them in envelopes, attached the required postage, and mail them for the client. It sounds like he never mailed them.
