    Sub S Election

    Can a Real Estate Associate Broker elect to become a Sub S Corporation with the intention to reduce SE taxes as a Sole-Proprietor?
    I realize some occupations cannot become Sub S Corps. Can an Associate Real Estate Broker become a Sub S?

    They can incorporate and elect Sub-S treatment via Form 2553. It doesn't mean they are going to avoid SE tax, because they then have to pay themselves a salary and file quarterly 941's on those payments. Many firms now require agents to organize as LLC's. Then they elect how it is to be treated for tax purposes. Associate brokers are treated same as agents for tax purposes. You should check Oregon state laws for rules for incorporation/LLC organization.
