    Taxpayer and spouse MFJ both are 70's. She still works being self employed. Have a 44 year old who is intellectual disability ( mental retardation) now a days I'm not for sure on the correct words - but with her working and only making about $16000 net it is saying they qualify for EIC. In my gut I want them to have the extra help giving them the EIC but not for sure the legal stuff. Can anyone help.

    Sounds EIC eligible. Since S/E is involved, I'd just make sure to retain good (client-supplied) records for income/expenses. Is the adult child receiving SS disability? I like to keep a copy of the disabled dependent's 1099SSA as proof of being an EIC-qualifying-child.

      "Proof of Permanently and Totally Disabled. To prove your claim of EITC for a child who is permanently and totally disabled, you need a letter from the child’s doctor, other healthcare provider or any social service program or agency verifying the child is permanently and totally disabled."

      Find out if your disability benefits qualify as earned income and if you can claim your disabled child to get the Earned Income Credit (EITC).

          Question of interest

          Just curious about this scenario.

          In theory the situation would allow a disabled (adult) child to qualify the older parents with some earned income to claim the EITC.

          However, isn't there a reasonable chance said parents might be running into a roadblock as relates to the AGI ($43,941) and/or investment income ($3,350) limits associated with claiming the EITC for one individual? (IRS info link: http://www.irs.gov/Credits-&-Deducti...Credit-Amounts )
