    Health Insurance for an HSA VISA worker

    Taxpayer is from Scotland. He doesn't have health insurance here in the United States, but he does have health insurance when he is in his home country. The rules to the Affordable Health Care Act states that Foreign Health insurance may qualify for minimum essential coverage. How do I find out if his coverage qualifies.

    Doesn't this law apply only to US citizens? You said he was "from" Scotland. What is his citizenship status? PS: If the AHCA states foreign health insurance qualifies, go with it.

      Most foreign insurance does NOT qualify. In order to qualify, the insurance company needs to 'apply' to the US Health department to be approved. He should ask his insurance company if they have done that and if they were approved. If not, it does not qualify.

      If he is a US resident alien, Green-card holder, or citizen, he will owe a penalty if he does not have QUALIFYING insurance (unless he qualifies for an exemption).
