    Taxpayer dies before refund issued

    Client filed taxes last week, but refund has not been issued yet and has since passed away. Will the refund still be sent or will family have to file more paperwork?

    Was the refund to be direct deposited or check?

    If DD then assuming the bank account has not been closed it will go there. If check then next of kind may be able to deposit if bank account is still open.

    Otherwise you will have to file a form 1310.

      Yes, the refund will still be sent in all likelihood. The IRS does not know he died yet. If MFJ, and direct deposit, no problem. Even if an estate account has been opened, the administrator can usually just endorse the check "For Deposit Only," and put it in the bank.
