    DOD in Sept 2014 form 1041 due 4-15-2015? I am working on another Estate tax return w/DOD in early May 2014 w/form 1041 due 3-15-2015. When the PR requested the EIN for the Estate did the PR answer some question about using the short year? Estate can file ext form 7004 but is 90% of the tax need to be paid with the ext?

    The election for fiscal year is made on the initial tax return filed. It is not made on the SS-4 request for EIN. So the issuance of the EIN letter always assumes a calendar year, which is the default. You can ignore it unless they actually want to use a calendar year. Otherwise, determine what fiscal year term you wish to use, and file accordingly. It does not have to be twelve months the first year.
