    MFJ-non resident alien

    US taxpayer marries a man from the Philippines. He has two children. Taxpayer wants to claim MFJ and the two children.
    Philippine man has no income and applying fot itins for all 3. Any problem with taxpayer filing joint and claiming kids?

      Do they meet all the tests, including being US citizens/nationals/resident aliens?
