    Applicant, not U.S. Citizen but applied for EAD card

    I have a college student who sent me their resume. Student is not U.S. Citizen, no Green card and is waiting their EAD card. The student currently volunteers at VITA. I was considering using student as a freelancer or independent contractor therefore do I need to wait until student receives their EAD card?

        I think you do need to wait until he gets the EAD before putting him to work...

        Does he have an SSN and PTIN??

        FYI: VITA volunteers do not need a PTIN, because they do not prepare returns for compensation, and under the regs, they do not fall within the definition of a return preparer.

        Also: You can't get a PTIN unless you have an SSN. There is an exception to this rule for preparers who are outside the USA.

        But if he gets an EAD, then he'll be eligible for an SSN. So this shouldn't be an issue...
