I have a customer who said they have an ITIN and wondered if they were going to be affected by the penalty. This has never come up before for me. Any references I should check out? thanks in advance.

Someone that does not have insurance either needs to pay a penalty or claim an exemption. Doesn't matter which flavor of TIN we're talking about, SSN or ITIN.
You're probably interested in code C - see page 2 of the instructions: http://www.irs.gov/pub/irs-pdf/i8965.pdf
"Not a U.S. citizen, not a U.S. national, and not an individual lawfully present in the U.S. For more information about who is treated as lawfully present for purposes of this coverage exemption, visit healthcare.gov."
Healthcare.gov has a list of statuses that could qualify to use the Marketplace (and thus would not qualify for the exemption due to the fact that they're lawfully present) here: https://www.healthcare.gov/immigrant...ration-status/
So, like anyone else - if they don't have insurance and don't qualify for an exemption they pay a penalty. If they do qualify for an exemption they claim the exemption instead.
