just wondering if my software is accurate
Sorry. I wasn't using software. I just took the amount that exceeded the filing threshold and multiplied that by 1%. But the actual calculation is the greater of 1% of the amount that exceeds the filing threshold, OR $95 times the number of individuals without insurance, with children counting as one half a person without insurance. So 1 adult plus 3 kids equals 95 + 47.50 + 47.50 + 47.50 = 237.50. Since 237.50 is greater than 195, the penalty is 237.50.

Still about the same as what the welfare queen charged for him to use her kids SSN on his return.

Excellent point about qualifying child vs. qualifying relative!

My client won that battle when his ex-girlfriend's aunt claimed his child because she was the landlady of the house these people were staying "rent free". Supposedly a chain store preparer advised this woman that she could claim the child because she had more income, provided a place to live etc.!
