    Taxpayer can be claimed as a dependent on another tax return.
    Is taxpayer eligible to claim HER OWN CHILD FOR EIC using her child.

    That's a big no. A dependent cannot receive EIC
    You have the right to remain silent. Anything you say will be misquoted, then used against you.

      Most likely correct as it makes sense but ... rules seem to say that you cannot be a qualifying child of another person. Could you be a qualifying relative and be OK?

        As usual, the omniscient TTB has covered this. TTB 3-20, the very last sentence on this page.

          Read it but to me it does not appear to address the question.

            You asked: Could you be a qualifying relative and be OK?

            TTB 3-20 says at the bottom: Claiming an exemption for a QR will not qualify taxpayer for EIC.

              Just entered such a situation into a practice problem. Where client is claimed as a dependent but has a qualifying child and viola ... software gives the EIC????
              I would not have guessed correctly.

                If you are saying that your software has returned the result that the taxpayer qualifies for EIC but is claimed as a dependent, then the questions were not answered correctly on Form 8867.

                  Maybe qualify for EIC if claimed as QR dependent

                  see TTB 3-18 situation #7 and corresponding footnote #8 on 3-19.
