    TP sold 2nd home in 13 but moved out 06.

    TP moved from residence for which he lived in 40 yrs in 2006 then sold it in 2013. Never rented it. In 2006 TP purchased another home and that has been TP's residence since 2006. TP received 1099-S. Basically a 2nd home. I am leaning no Sect 121 but you comments please.

    He is well beyond the months out the past five years test. Sect. 121 is out.
