    Power of attorney

    A client has a son in jail. She has an attorney written power of attorney. Can this form be a substitute for Form 2848? Does Form 2848 have to be completed?

    If the POA gives her the power to sign tax returns, then you're good. I actually saw two this year that spelled out tax return issues as well as the usual. I complimented the paperwork to my clients and told them their lawyers had been thorough and saved them a form that would need the (in my case, elderly &/or ill) taxpayer's signature by covering that case in the POA.

      I would have the POA holder, if it includes tax issues, also submit a F56 with a copy of the POA attached. This should be submitted separate of any tax returrn.
      Believe nothing you have not personally researched and verified.
