    Mexican Tax Returns - How do I file to recoup 25% Tax with-holdings

    I need assistance or guidance to put me in the right direction to file
    Mexican tax returns for the year 2012.

    My client (An LLC Establishment) in the United States engaged
    in a business transactions in Mexico where a 25% with-holdings tax was
    assessed and withheld from their revenue proceeds earned in Mexico.

    We are looking for assistance and guidance to file a return to report
    and disclose this income earned with the intent of recouping the 25%
    with-holdings with the Mexican taxing authority.

    Please advise what process is involved and how to proceed with this.

    The US has a tax treaty with Mexico. You can download the entire thing from the IRS website. Deloitte also publishes a Tax Guide for Mexico which you can access.

      never handled one, but I thought on the sale of real estate there for nonesidents-they just take like 25% of the gross, you do not get it back!! Who has handled one of these??

        Some of the states do an automatic withholding on real estate transactions when the person lives out of state.

        The only way you get any credit is to do a state income tax return and you do get some of it back. Similar to W-2G's issued for gambling in some states.

        I don't know about Mexico.

          Because I don't do any international tax returns I refer them to someone who does it routinely.
          Too many things could go wrong if you are not up to speed. I had a very good client (a Doctor) that started a business in India and wanted me to handle the Indian tax return which I was totally unprepared. Had to send him to a CPA in New York.
