    Can ex wife of TP sign POA?

    Got a call from the ex wife of the TP who received a letter from IRS owing money for tax year 2011. As mentioned ex wife but she received a letter since they were still married all of 2011 and filed a MFJ. Its probably going to be impossible for the TP to sign a POA thus allowing me to talk to the IRS. Anyway I can get around that? Will only her signature be valid?

    You must have a POA signed for each one.Why can the taxpayer not sign the POA?

          I thought about conferencing her in but the wait with the IRS is about 40 mins but I may have no other choice.

            If return is filed MFJ you need POA from both spouses according to IRS. Had a situation where the husband had died. Had to provide proof of death.

            Remind the spouse who is not cooperating that IRS does NOT care that they are divorced now and not on speaking terms. They are responsible jointly and severally. So if that person has more assets/income guess who IRS will be hounding.

              POAs are Now Separate Forms for Each Spouse

              IRS revised Form 2848 as of 2 years ago - where EACH spouse must sign a SEPARATE POA - even for a
              MFJ return.

              If you get ex-spouse to sign her POA - then I would contact PPS and find out how to get around the
              other spouse's absent signature. But be sure to call PPS 7:00AM - then there's virtually no wait time.
