    Loving Case

About three weeks ago, the Supreme Court was hearing an appeal by the IRS on the Loving Case. I have not seen news headlines about the decision, nor have I read anything on this forum about it. One of my associates told me the IRS was not doing very well, but it may end up being up a moot point because the Treasury Dept has attached an amendment to forthcoming legislation which will nail down their position.

Have I been on Mars while the news was being released? If so, I would kindly appreciate if someone would fill me in.

Last year, three tax preparers sued the Internal Revenue Service to prevent the agency from pushing ahead with new regulations. The three were successful - and the IRS filed an appeal. Yesterday, the IRS had the chance to tell a panel of judges why the regulations are appropriate. Were those oral arguments convincing?

It was not the Supreme Court but the Appeals Court for the District of Columbia that heard oral arguments from both parties on September 24th. A decision will be released on ??????

NYEA - correction noted. Thanks. Apparently a hearing only - thus no decision.
