    Non-Discrimination Testing - Health Insurance - test failed - tax implications?

    For a corporation (less than 50 employees) the provides health insurance and FSA to employees (health insurance paid equally by employer and employee) which failes the non-discrimination testing, what are the implications for deductibility of the employer portion of the health insurance premiums? Or any other tax implications? Thank you.

    What are the ruyles for under 50?

    I think the rules stipulate for those ove 50 employees coverage if there has to be in place for over 30 hours a week worked.. Is it the same for under 50 employees - if one week out of 52 goes over 30 what happens? How do you test???
