    Client in jail

    Client worked at a regular job before going to jail. His income qualifies for EIC, is he eligible?

    Nothing in the code or the IRS Pub on EIC says anything about denying the credit if the taxpayer is in jail.

      Don't have many/any EIC clients. Does the taxpayer have to live with the child for over six months? Did he have a child? Was he living with the child over six months? Or was he in jail most of the year?
