Does your tax software require spouses data to e-file MFS?

The 1040 instructions give an example where you wouldn't enter the spouse's SSN. If the spouse does not have and is not required to have an SSN or ITIN (non-resident alien). Software should be able to transmit a return in that scenario. Might be you can ignore an error when transmitting or something like that. Not sure about name. I'm not sure about the community property indicator / Form 8958 though, for those in community property states.
It is an IRS reject if the spouse name control is missing, F1040-110. So appears at minimum name will be required or the return will reject.Last edited by David1980; 04-30-2013, 09:16 AM.
