    Community Property State

    Client, couple, live in community state. Husband is on retirement, over 65 and drawing Soc. Sec.
    Wife, under 65, still employed not drawing Soc. Sec.
    By dividing the W-2 earnings and retirement pay 50% ea. and have them file MFS
    would the husbands Soc. Sec. Benefits be divided equally between the two or would
    the husband report all the S S Benefits on his separate return? The do live together.
    Not separated.
    Wifes W-2 Wage $ 29,721 W.H. $2,993.
    Husb. Retire. 15,926. W.H. 1,154.

    Total $ 45,647. 4,147.
    Each one would report 1/2 of total on the separate returns.
    Husb. S S Benefits 19,142.
    Would this be divided equally also?

    Yep, split SS too.

    Why are you doing a MFS in community property?

      mfs - community property state

      Husband would report 100% of the ss on his return as TAXABLE income as he's mfs.
