    WV Tax

    Client lives in Miami Florida. Has K-1 from WV with capital gains, rental loss,Interest Income.

    The Question is; Does client have to file WV tax.

    To those wonderful people in West Virginia. Sorry to intrude on your Easter parade.

    TTB, All States Edition, page WV-1, nonresidents "are required to file...if they receive any West Virginia source income while a nonresident."

    So yes, if any WV source income is on the K-1, your client has to file a WV nonresident return.

      Bees is correct. I do a few WV returns since this is a contigous state and the good folks in Charleston expect non residents with WV source income to file a non resident return. If you don't file they will generally go to the source and require withholding if there are any cash distributions involved. Check their website www.state.wv.us/taxdiv

        Filing Thresholds

        Deltax, everything you've been told is correct about WV, except you should look into their minimum income levels for filing, and not file unless your client's WV income exceeds.

        WV is extremely easy state to work with, having low tax rates, and workable personnel who are not arrogant like some states. One of my favorite states - both for low key commerce, and for exhiliarating vacations...
