So, am I right...the IRA Qual Chartiable Contribution is not available in 2013?

It is not available for distributions made in 2013.
As part of the "Fiscal Cliff" legislation that was passed on January 1, Congress made some rather bizarre, retroactive provisions for distributions that occurred in 2012, including certain distributions that were made in January, 2013. In order to take advantage of these provisions, the taxpayer had to act on it by the end of January.

Actually, the entire provision was made retroactive for 2012 (hence the screwy rules for catching up in January) but it was also extended for 2013. It expires 12/31/13 if not extended again. See ATRA supplement, The TaxBook News, page 23.Last edited by Burke; 04-02-2013, 07:04 PM.Comment
