    Amended deadline for 2009 form 1040- does an audit in 2011 give them past 4/15/2013

    I have a client who wants to amend their 2009 tax return. It was audited and they represented themselves at the audit. They were assessed a substantial amount of money. Do we have until April 15, 2013 to amend the 2013 form 1040? Or do we have 3 years from the date of the date the audit amount was assessed? Or do we have any additional time because of the audit?

    It is possible having the audit might buy a little extra time depending when they paid the addtional taxes. Read these instructions from the IRS for Form 1040X to determine the deadline for amending the return.

    When To File
    File Form 1040X only after you have filed your original return. Generally, for a credit or refund, you must file Form 1040X within 3 years (including extensions) after the date you filed your original return or within 2 years after the date you paid the tax, whichever is later. If you filed your original return early (for example, March 1 for a calendar year return), your return is considered filed on the due date (generally April 15). However, if you had an extension to file (for example, until October 15) but you filed earlier and we received it July 1, your return is considered filed on July 1.


    However, one would wonder what they can amend on an audited return.

      My question is...if they agreed to the terms of the audit how are they going to amend a return that they told the IRS was accurate at the time the audit closed?
      Believe nothing you have not personally researched and verified.
