November drop out eligible for AOC or LLC?

If a student starts semester classes but later withdraws and did not receive a refund of any sort, can either the American opportunity or the lifetime learning credit for qualified education expenses not refunded be taken?

    Yes

LLC I am sure the answer is yes, because I had this come up a year ago and researched it.
AOC I think the answer is yes but am not toally sure.

      AOC - Yes

On page 11 Student withdraws from class(es). You can claim an American opportunity credit for qualified education expenses not refunded when a student withdraws

Depends on how long he attended school. TTB addresses this. The fact that many schools do not refund tuition just because the student drops out, may not qualify for the credit if attendence doesn't meet the credit requirement.
Believe nothing you have not personally researched and verified.

I believe that statement to be 100% incorrect. If the student was "enrolled at least half-time in a program leading to a degree, certificate, or other recognized educational credential" along with other qualifications for the AOC or LLC was my focus. Enrolled does not equal attend, therefore I take this to mean it does not depend on how long he/she attended the school, or do you have a cite to show otherwise?
