    Form 4852

    Taxpayer wants to file his 2012 tax return as soon as possible. Is it ok if I prepare a Form 4852 for him from the information on his check stubs so he can file the tax return right away? Or does he have to wait for the W-2 from his employer?

    He must wait for the W-2. Form 4852 cannot be filed until after Feb. 15th. Also, you must give an explanation of the efforts made to obtain the W-2.

      TAxpayers somehow think employes have to mail W2's to them. Actually there is no mailing requirement; just that employer must have W2's available by Jan 31st. Tell the buy to go pick it up.

            No ---software updated is NOT available - Only working with it for preliminary - but less than perfect - indicators are not before 1/22/2013!

            Not sure of the official Efile opening date, but pretty sure it will be 1/22 or later!

              I got my Lacerte software in mid November. Many forms were unavailable & yet to be approved by IRS. But then even the service had not finalized certain form lines & instructions due to Capitol Hill goofing off. There was another update in mid December. Their notice on 1/2 said: There will be a Lacerte update release on January 9th that incorporates the extension of the tax laws that the government has recently passed. This update includes the provisions that expired at the end of 2011 and impact the 2012 tax return, such as the AMT patch and the deduction of state and local sales taxes. Plus there will be weekly updates thrioughout tax season.
