    LLC partnership to LLC sole proprietor

    Do I have to file an 8832 to change. LLC partnership is husband/wife. Wife does not participate and we want to go to a llc sole prop filing sch c. I believe the EIN number stays the same, but do I have to notify IRS of the change? I am going to file a final partnership return for 2012, and start as sole prop llc in 2013. I've talked to state and they say if EIN changes I have to change some things with the state, but otherwise I can continue with all state numbers as before. Any suggestions, help, resources. thanks

    When all else fails,

    (as they say).. read the instructions, in this case the instructions to the SS4 form. Is this situation addressed there?

      I read the instructions. It says that ss-4 is not an election for tax classification, but when i applied I applied as a partnership with the partnership name first rather than the individual. Will that be a problem? he is listed as the principle person. It's the same business.

        I called IRS and they confirmed that no new EIN is required.
