    Bot 1 I-Pad received 5.

According to the below article, Best Buy said the guy can keep them all at no extra charge. I am curious, will Best Buy send the guy anything like a 1099-misc for the value of 4 I-pads which could $2K?

How? I don't believe they would have his SS #.

And as far as taxable income, irregardless of any 1099, the 4 are a gift.

Some years ago I ordered from Home Depot a wrought iron patio table, umbrella and four iron chairs. (2 boxes of 2 ). They misinterpreted and sent 4 boxes, thinking in terms I guess of the 4 chairs I had ordered. I tried to get them to take back the extra 4, but they were adamant. There was just no provision in their procedures for this. EVENTUALLY I found a home for the extra four chairs.

        Company Policy

Two years ago I ordered a $69 calculator from Quill; they sent the wrong one, I called for return instructions, they said donate it to charity (too much expense returning, restocking, etc., I suppose), and sent me the right one. In the past they'd had me to send the stuff back -- I don't know if this new policy will become a permanent practice for most businesses, but it's kind of nice. I gave mine to a "pore-boy" client in need (guess he's as good a charity as anybody else).

P.S. There was no 1099 and I wouldn't expect one. If it's too much trouble to take the merchandise back, then without doubt it's going to be too much trouble to get his SSN and 1099 him.

I agree with everyone that it's a gift. But if there were some provison for it being taxable income, I'd gladly pay the tax on 4 extra iPads if that's what it took to keep them.
