    Office in home depreciation

Could there ever be a situation where a taxpayer, who ownes his own home, qualifies to take an office in home deduction but does not qualify to take a depreciation deduction for the portion of his home used as a home office?

Yes, certain OIH deductions, including home depreciation cannot create or increase a net loss. Unallowable deductions are carried forward until eligible to claim.
      See Pub 587.
