    back taxes owed by deceased taxpayer

    Married taxpayer dies in 2011. The couple always filed MFS. Deceased taxpayer owes taxes from 2004 in the amount of $4000. Spouse wants to know if she has to pay it. Deceased taxpayer has no assets. The home is in wifes name. The IRS list the debt as "currently not collectable". No estate tax issues involved. What say you?

    Is it a community property state?

    If not, I would say that she doesn't.

      I had a similar situation a few years back. TP always filed MFS. TP owed taxes in year of death. TP was insolvent on DOD. Replied to IRS demand letters stating such. Never heard another thing. This was in a community property state.
