    Roth Distributions

    A person 61 years old Set ujp A Roth annunity about 3 1/2 years ago. Can he take a tax free distribution now of the original funds or will he have to wait another 1 1/2 before doing that?

    Contributions to a Roth can be withdrawn at any time, no taxes, no penalty and no time limit.

      See page 13-14 of THE book., second column. it indicates that the five year rule applies, so a portion of the distribution would be subject to tax, no?

        Only earnings taxable under 5-year rule

          And unlike a regular IRA, distributions from a Roth are considered to come first from contributions, then from conversions, and lastly from earnings. So even if the Roth account had earnings, the distribution may not.

          Of course, the annuity itself may have some early withdrawal penalty.
