    Mfs - Childcare Expenses

    Couple lived together for 11 months in 2011 and separated in December. Both work and have earned income. They are filing MFS and wife has already filed. Dad wants to claim the childcare expenses. It would seem that he could not, seeing that he is not "considered unmarried" being only separated one month. My software does not take this deduction. Does it sound like he would not be eligible for the deduction?

    Not eligible for the credit based on the given information, as he cannot be considered unmarried.
