    dependency exemption

    i have a guy who wants to claim his girlfriend and the girlfriend's kid. obvioulsy no EIC. but based on what he says, they lived with him for the entire year, he provided all supports, and they made no money. I guess they qualify since they lived with him all year eventhough they are not related. however, i believe he does not qualify for HOH. correct?

      Agree, and...

      No child tax credit, either. The dependent relationship is other or none.

      At the risk of stating the obvious, it is also important to find out if anyone else lived in the home. Clients often don't mention that sort of thing either because they don't understand that it may be very relevant, or because they are trying to play the system.

      For example, on your fact pattern, if the client, his girlfriend, and his girlfriend's child all lived in the same household as the girlfriend's mother, and she had some real income, that changes the entire equation--even if you hold all the other variables constant.
