A 41 year old single mother was mudered 7/03/05. She had custody of her 13 year old daughter who lived with her. The daughter is now living with her father. Her mother and the father were never married. She rented in 2005. She had no estate, there is no probate, administrator, executor, personal rep or court appointed representative. Her parents are in process of getting custody of the child. She had $18,236 in W2 wages. Her filing status is HOH and she takes the standard deduction. Before applying the Child Tax Credit and EIC she has a $453 refund coming. There are outstanding student loans. Questions: should her parents file her 2005 taxes and attach Form 1310 ? Is she eligible for the Child Tax Credit and EIC ?

.. I see no reason why she should not get EIC or any other credit. Yes, her parents are the likely choice for the 1310. More than likely any refund will go to FMS to cover her outstanding debt, if in collection.
File her return just like previous year but applying current situation. She maintained a home for her child for more that 6 months, so go for it.This post is for discussion purposes only and should be verified with other sources before actual use.
