    Davis Bacon Act

    would any one know?

    if a grantee/subgrantee hires an individal who is "Self-Employed" (not a sole proprietor)to do work, is the grantee/subgrantee exempt from DBA(Davis Bacon Act) and there is no reqierment for certified payrolls, or is he still subjact to Davis Bacon Act rules?
    help and reference is appriciated.

    Someone who is self-employed IS a sole proprietor under federal tax law.

    But Davis-Bacon is not federal tax law. It is something else. And I think I understand your question.

    Davis-Bacon IS applicable to independent contractors. The fact that they are not employees under federal tax law does not mean that they are exempt from Davis-Bacon.

    There is an exception for independent contractors who are business owners, and I think that's what you meant when you said that they are "self-employed" but not "sole proprietors."

    Check out this handbook published by the US Department of Energy. It is a general discussion of the Davis-Bacon act that is not limited to contracts awarded by DOE.
