    What did we decide re converting residence to rental and then selling?

    How long do you have to rent it or hold it out to be rented before you can claim a loss?

    What is the basis for the loss (assuming it is worth less than the original cost) ...... FMV when you put it into service less depreciation? That might negate some losses but the market could be in further decline or there could be large selling expenses involved.

    I don't recall there being any "Magic Time Frame" when a home turned rental becomes a rental and entitled to disposition losses.

    I would say it depends on the facts and circumstances of the conversion to rental.

    If it was like 3 weeks, I would say you would have a battle. If you held it and rented it for nine months or longer, you could build a case for the loss. If the client was out of state and could not manage the property and had a management company that rents houses that also would solidify your case.
