    EIC when one MFJ is 24

    I had a couple tonight with 3 qualifying children and within the income limits for EIC. The filer (husband) was 24 at the end of 2011 but the spouse (MFJ) was 25 at the end of 2011. My tax software would not claim the credit for them, but I'm wondering if the mistake was mine. Should they get the credit?

    Their age is irrelevant when they have kids, so check the other EIC questions.

      Probably a question answered wrong that disallows the EIC.

        Likely candidate is "can you be claimed as a dependent by someone else?"

        Most tax software will generate error/omission listings for such....

          Thanks so much, it was a question I had marked wrong in the software, should have known 24 was irrelevant with kids, lack of sleep!
