    8332

    This is the first return I've had this year that requires a signed 8332. Any trouble e-filing this? Does this signed form go in or do I keep it?

    Ok, I know I send the 8453 with this signed form, any trouble e-filing?

        I believe it should be sent as soon as the return is accepted.

          You have to mail it within three business days after receiving an ACK from the IRS.

            My uderstanding is that the custodial parent can give this exemption to the non custdial parent per their divorce agreement, but the custodial parent is still entitled to HOH status, just not claiming the dependent if they gave up that right. Am I right?

              Am I right? Yes the parent is then entitled to possible HH filing status, Dependent Care Credit, EIC, etc.

                  Custodial parent gets HoH, EITC, and daycare credit.

                  Non-custodial parent gets exemption and CTC (if he has a signed 8332).

                      Speaking of the 8332. If the custodial parent is living with boyfriend who is taking both her because she doesn't work and is also supporting her son; does he take the son as qualifying relative and get an 8332 from her?
                      Believe nothing you have not personally researched and verified.

                          You are correct; Form 8332 is only used for separated/divorced parents and it allows the custodial parent to release the CTC and exemption to the non-custodial parent. It should never be used by anyone except the legal parents of the child.

                            Taxea .. in regards to your question, what would or could be relevant is if the mom did not work and between the mom and the dad (non custodial parent) they did not provide over one half of the support for the child, then mom technically should not or could not release the exemption via form 8332 to the dad. Then if the boyfriend provided over one half of the support he could claim the child as a qualifying relative.

                              The Form 8332 can only be used by the custodial parent to allow the non-custodial parent to claim their child. The custodial parent cannot sign off to anyone they please such as a boyfriend.
