    qualifying child for EIC

    is a child that is born in december of 2011 a qualifying child for eic? is the assumption that the child lived with the parents for the whole year for the year that the child was born? obviously the child lived with parents for one month, however that is the year the child was born. thanks

    Yes, see page 244 of Pub 17:

    Birth or death of a child. A child who was born or died in 2011 is treated as having lived with you for all of 2011 if your home was the child's home the entire time he or she was alive in 2011.

      so in the software

      where the question asks did the child live with the taxpayer for more than half the year, then the answer would be yes, correct?

        Yes, that is what Pub 17 is saying.

          Software

          The software should have some notes, or a help screen, somewhere...

          which will say that if the child was born in 2011 and lived with the parents for the entire time from the date of birth until 12/31, then you should enter 12 as the number of months that the child lived with the parents.
