    Form 3903 & Retiree

    Retired TP for 10 yrs wants to deduct his moving exps and I replied you needed to be employed which could also been self employed for which he was neither. I asked him if you plans to get a job and replied no. He said when he moved 5 yrs ago, the CPA deducted his moving exps. I ask him if he got a job back then, he replied no. Seems to me not filing a Sch C or a W-2 with TP's tax return that included a 3903 would have triggered a letter from the IRS. Is there something out there for a retiree to file a 3903 for which I am not aware of?

    Your take on the situation is dead on.

      You might also tell him to cross his fingers that the IRS doesn't find the error in the prior return and come after him for penalties and interest on that one.
      Believe nothing you have not personally researched and verified.

        i am thinking taxpayer may have given the moving expenses to the preparer, but, did the preparer actually use it on the return? maybe that's why he hasn't heard from IRS.
        do ALL your clients really look at their returns?

          It was several yrs ago and there is no need to bring in that tax return. I am having mixed feeling if I even want to take on this client.

            There is are exceptions to the time requirements for retirees or survivors moving back to the US from other countries, as well as for members of the military (whether or not staying in the military). It doesn't sound like these apply in this case, but I thought I'd point them out just in case.

              If he still has a copy I think this warrants taking a look at it. Or you could get a POA for that year and get a transcript from eservices.

              Being prior law enforcement I don't believe anything I haven't verified. Others could be right
              maybe he gave the info to the preparer and just didn't realize it wasn't included in the return
