    couple has a Capital Loss carryover of $21000. Do they split this amount? Nothing is stated in the divoce papers.

    Whose losses are these? Joint, then yes you split. Otherwise it goes by ownership.

      Not sure

      whose name(s) were on the stocks sold. Husband handled all the finances and the wife (my client) doesn't know how the stock were titled. We are in Illinois so not a community property state.
