My client came in and filed taxes as head of household, Claiming she only lived with her husband the first 5 months of last year. Now, she wants to amend her return using Married filing joint. Is there a rule of having to live with the spouse as far as filing married filing joint?

Sounds like your client may be a bit shady. If it can be proven that she filed HH to obtain certain child related credits someone must have set her straight and she decided that a accurate return was better than going to jail.. There is a law on the books against tax fraud.Believe nothing you have not personally researched and verified.
