    Married filing Head of Household

    My client came in and filed taxes as head of household, Claiming she only lived with her husband the first 5 months of last year. Now, she wants to amend her return using Married filing joint. Is there a rule of having to live with the spouse as far as filing married filing joint?

      No, but in California there is an 1863 law on the books that has never been repealed, which says that if the value of the couple's community property is under $20, and the couple has not had marital relations in over a year, then the marriage is dissolved by operation of law.

        Sounds like your client may be a bit shady. If it can be proven that she filed HH to obtain certain child related credits someone must have set her straight and she decided that a accurate return was better than going to jail.. There is a law on the books against tax fraud.
        Believe nothing you have not personally researched and verified.
