    State Efile Question

    I filed a return with injured spouse claim back in April. Client called last month saying they had not received the State refund yet. Injured Spouse is the wife, husband owes back Fed and State Taxes. This was for the state of Georgia. I efiled the return and I was under the impression that the state got a efile copy of the federal.

    Well I called the state of georgia and they asked did I send in the injured spouse form with the state return. I stated that I thought they got it when the return was efiled. I did not get a response just to fax in the return and they would process it.

    So question is, do the states get a copy of the Federal return? Is it only certain forms they receive?

    I want to make sure this does not happen next year.

    At a meeting hosted by our Revenue Dept. for tax professionals the subject came up about what forms are sent along from theIRS to the state. They explained that each state tax department has a list of required federal forms to be sent with the state return. Some software companies only send what each particular state requires, some send everything. In my case, the state never gets the form for Native American exclusion of income from state tax, and they said they don't require it be efiled and my software company is one that doesn't send it if it's not required. You might check with Georgia revenue dept. to see what forms they require on an efiled return, it may be they don't require the injured spouse form from theIRS.

      My software

      tells me that the appropriate Fed forms are submitted with, but in the last year or so, I have encountered a couple of states on non-resident - that did not seem to receive the Federal or the "other state" copies

      Guess it could be a hit or miss

      Maybe check with your software provider.
