    2441 and schooling

    Has anyone noticed that the 2005 2441 instructions now state that you cannot use schooling for Kindergarden and above...whereas, in prior years it stated first grade and above? This fact wasn't included in the "What's New" section in the instructions. Quickfinders and The Tax Book still have it as first grade and above...am wondering if it's a misprint on the instructions...hope so.

    2005 Pub 503, page 6 says “expenses to attend kindergarten or a higher grade are not expenses for care. Do not use these expenses to figure your credit.”

    2004 Pub 503, page 6 says “Expenses to attend first grade or a higher grade are not expenses for care. Do not use these expenses to figure your credit.”

    There was no law change in this regard. IRS must have decided to make up some new rules for this year.

      And now

      we have "4 year old kindergarten" and "kindergarten" so would costs for "4 year old kindergarten" count for qualified expenses?
